This change seeks to clarify that no individual, a player or not, may use a device to record or count cards being played. 20:18:12.01:27. Use of recording device prohibited. This rule seeks to clarify that no gaming may be recorded unless prior authorization is received by the Executive Secretary of the South Dakota Commission on Gaming. 20:18:18:15. Maintenance of slot machines. Modification of this rule seeks to clarify what products constitute parts to the associated equipment for purposes of licensure and administration of licensure structure. 20:18:12.01:07.01. Entitlement to slot machine credits or payouts and to abandoned monies. This rule clarifies the amounts for which licensees must conduct investigations in effort to return abandoned tokens, cash or chips. Gaming Internal Control and Revenue Reporting Manual Appendix A. This rule change seeks to implement the W-2g changes that occurred due to the passage of Congress’s One Big Beautiful Bill and will correlate reporting standards and our rules to the amounts mandated by the Internal Revenue Service. 12/16/2025 11/26/2025
Electronic Title and Registration Program The effect of the rules will be to require vehicles to be registered and titled in an individual’s legal name, to establish the Electronic Title and Registration (ERT) program, set forth ERT application requirements, require ERT provider annual fees, responsibility for technical costs, document retention requirements, and establish penalties for failure to remit state taxes and fees as required. The reason for adopting the proposed rules is to implement the ERT program as required by state law, to ensure that ERT providers comply with necessary technical requirements of DOR’s 605Drive system, ensure the timely remittance of state taxes and fees by ERT providers, and ensure compliance with federal document retention laws. 03/31/2026 05/05/2026 04/14/2026
South Dakota Commission on Gaming amendment of Administrative Rules 20:04:27:12, 20:04:27:14. the effect of the rule changes will update the rules to the ARCI controlled therapeutic medications schedule and uniform clarification guidelines to the most recent ARCI standards. 20:18:15:30.03 - Variations of the play 21 + 3. The rules proposal modifies the existing structure for a Blackjack variation of play and includes alternate pay tables 20:18:15:30.17 - Variations of the play TriLux Bonus Blackjack Progressive. Lottery Draw Game Updates The effect of the rules will be the adoption of the updated Millionaire for Life game rules, the adoption of Powerball Xs & Os game rules, and the repeal of obsolete rules. The reason for adopting the proposed rules is to ensure that retailers can continue selling the Millionaire for Life game, to enable retailers to sell the new Powerball Xs & Os game, and to repeal obsolete rules which helps to keep the rules up to date. 06/11/2026 06/05/2026
