South Dakota Department of Health - Nurse Aide Repeals language in ARSD article 44:74 that is duplicative of Board of Nursing requirements in ARSD Chapters 20:48:16 and 20:48:18 that became effective in September 2025. Section 44:74:02:06 is transferred to a new 44:73:06:15. Section 44:73:06:14 is a new proposed rule that clarifies a facility's requirements regarding CNAs that was previously addressed in 44:74. The proposed rules in ARSD 44:70:01:01, 44:70:05:06, 44:73:01:01, and 44:73:06:07 update the language to reflect the ARSD changes from September 2025 and the proposed repeal of the ARSD article 44:74. 07/21/2026 08/18/2026 07/31/2026
South Dakota Department of Health - Office of Rural Health and Emergency Services The United States Department of State (USDOS) has updated its document order requirements for J-1 Visa Waiver applications and now allows applications to be submitted electronically. The proposed changes to ARSD 44:63 incorporate these federal updates by revising the required order of documents in the application, allowing electronic submission of J-1 Visa Waiver applications, requiring the application fee to be received within 10 business days of electronic submission, revising the definition of full-time employment to clarify requirements for shift-based physicians, and allowing the case number to be displayed in the bottom right-hand corner of each application page. 09/09/2026 10/14/2026 09/19/2026
South Dakota Department of Health - Office of Medical Cannabis The Office of Medical Cannabis is updating and clarifying requirements throughout Article 44:90 to align with current medical cannabis industry standards, improve consistency, and modernize administrative processes. South Dakota Department of Health - Newborn Screening The Office of Lifespan Health is adding three new conditions, Duchenne Muscular Dystrophy, Mucopolysaccharidosis Type I (MPS I), and Mucopolysaccharidosis Type II (MPS II), to the required tests under the newborn screening program based on nomination, review, recommendation, and approval by the state's newborn screening nomination committee and the newborn screening advisory committee. 09/23/2026 10/14/2026 10/03/2026

South Dakota Board of Massage Therapy The proposed rules will remove from rule the list of recognized facilities to offer massage education and instead require posting to the board website, clarify the acceptance of out-of-state education, state that in-state schools must apply to be a recognized facility, add criteria for the application process, and develop criteria for who is eligible to teach massage therapy. 10/02/2026 10/14/2026 09/29/2026
