Animal Industry Board Proposed Rule Changes

1. Amend ARSD 12:68:01–Definitions. Effect: The proposed rule will update definitions to more accurately reflect current terminology and to modernize language of reference material. Reason: To make definitions more consistent with national health programs. 2. Amend ARSD 12:68:03–Livestock Disease and Parasites; 12:68:10–Swine Identification; 12:68:19–Ram Epididymitis Control; 12:68:28–Scrapie Control and 12:68:29–Livestock Identification. Effect: The proposed rules will consolidate animal identification rules into one chapter. Reason: To have animal identification rules in one location for all disease concerns and to provide for confidentiality of records as directed by SDCL 40-3-27 to 40-3-29. 3. Amend ARSD 12:68:04–Tuberculosis Control and 12:68:05–Brucellosis and Contagious Abortion. Effect: The proposed rules will eliminate redundant language which is already outlined in national program guidance for disease control followed by the Animal Industry Board and to update current language of reference material. Reason: More accurately reflect disease response activities which follow federal guidance. 4. Amend ARSD 12:68:14–Meat Inspection and 12:68:23–Tuberculosis Control in Cervidae. Effect: The proposed rules would change and update current language of reference material. Reason: To be consistent with national animal health programs. 5. Amend ARSD 12:68:15–Meat Establishments. Effect: The proposed rule will allow for recognition of other state agency inspections already conducted. Reason: Assist establishments under dual authorities in meeting regulatory requirements. 6. Amend ARSD 12:68:18–NonDomestic Animal Control. Effect: The proposed rule will eliminate brucellosis test requirements for imported cervids and update identification language to align with federal guidance and to update current language of reference material. Reason: To recognize brucellosis in cervids is a negligible risk. 7. Amend ARSD 12:68:21–Brucellosis Control in Goats and 12:68:22–Tuberculosis Control in Goats. Effect: The proposed rule will clarify animals subject to official testing require identification and responsibility for payment. Reason: To bring testing in goats in line with federal requirements. 8. Amend ARSD 12:68:24–Brucellosis Control in Cervidae. Effect: The proposed rule will eliminate redundant language which is already outlined in National program guidance for disease control followed by the Animal Industry Board and to update current language of reference material. Reason: To be consistent with national animal health programs.
