Behavioral Health – Appropriate Regional Facility

These new rules are a result of SDCL 27A-10-1.2 which was created by SB 4 during the 2020 Legislative Session. The rules outline the minimum standards that facilities must meet to be designated as an appropriate regional facility. These facilities will provide short-term inpatient crisis stabilization services to individuals regionally with the goal of preventing unnecessary admissions to HSC and keeping individuals in crisis close to home. It is possible that some of the facilities seeking designation by DSS would not be facilities that are regulated by any other entity. These rules are intended to provide DSS the level of oversight needed to protect the health and safety of individuals served in these appropriate regional facilities without creating unnecessary hurdles for facilities seeking designation.
